Air Line Pilots Association v. Quesada

March 14, 1960

AIR LINE PILOTS ASSOCIATION, INTERNATIONAL, ET AL., PLAINTIFFS-APPELLANTS,
v.
ELWOOD R. QUESADA, DEFENDANT-APPELLEE.

Author: Waterman

WATERMAN, C. J.: Plaintiffs have appealed from an adverse decision rendered today. The court below denied an injunction pending disposition of the appeal, and plaintiffs now move in this court for such an injunction. A rule to show cause having been issued why the stay pending appeal should not be granted, and hearing having been held, after consideration I find that the decision below denying a stay pending appeal should not be set aside, and the stay prayed for is denied. However, the case should be brought on promptly for hearing on the merits, and the appellants therefore shall file their briefs and appendices on or before March 30, 1960, and the appellees on or before April 7, 1960, the argument of the appeal being set for April 8, 1960, at which time plaintiffs may again seek to have a stay granted pending final disposition of this appeal.
