National Labor Relations Board v. Reliance Fuel Oil Corp.

February 26, 1963

NATIONAL LABOR RELATIONS BOARD, PETITIONER
v.
RELIANCE FUEL OIL CORPORATION, RESPONDENT.

Author: Lumbard

Before LUMBARD, Chief Judge, FRIENDLY and SMITH, Circuit Judges.

LUMBARD, Ch. J.: On petition for enforcement of an order of the National Labor Relations Board, 129 NLRB No. 141, this court denied enforcement and remanded to the Board for further hearings and additional findings on the basis of the Board's jurisdiction, 297 F.2d 94. The Supreme Court reversed. - U.S. - January 7, 1963.

This court, 297 F.2d 94, at 96 held that "The findings on the merits are adequate and adequately supported by substantial evidence. Reimbursement is appropriate under these circumstances. The Board's order, including the provision for reimbursement, must therefore be enforced if the Board had jurisdiction over the dispute."

The Board's jurisdiction is established by the decision of the Supreme Court.

Decree may issue enforcing the Board's order in full.
