This cause came on to be heard on the transcript of record from the United States District Court for the Western District of New York, and was argued by counsel.

ON CONSIDERATION WHEREOF, it is now hereby ordered, adjudged, and decreed that the order of said District Court be and it hereby is affirmed on the opinion below of the Hon. John T. Curtin, dated June 28, 1978, to the extent that it found no violation of defendant's right to a speedy trial, and no violation of defendant's right to the effective assistance of counsel.
