Appeal from an order of the United States District Court for the Southern District of New York, Edward Weinfeld, Judge, dated July 29, 1982 and reported at 543 F. Supp. 1340 (S.D.N.Y. 1982), granting summary judgment for plaintiff-appellee-cross-appellant Commodity Exchange, Inc. (COMEX) vacating defendant-appellant-cross-appellee Commodity Futures Trading Commission's (Commission's) disapproval of the COMEX Straddle Rules and instructing the Commission to provide COMEX an oral hearing.
